authorizing the Administration to issue nonresident
permits; providing for the permit fee and expiration
period; and generally relating to the issuance, form
and expiration of nonresident permits.

Section 11-149 and 13-402(c)
Annotated Code of Maryland

BY adding to

Article - Transportation
Section 11-113-1 and 13-402.1(e)
Annotated Code of Maryland
(1977 Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Transportation

11-113.1.

"DOMICILE" MEANS THE PLACE OF A PERSON'S TRUE, FIXED,
PERMANENT HOME, WITHOUT ANY PRESENT INTENTION OF COMPLETELY
ABANDONING THAT HOME, AND TO WHICH HE HAS THE INTENTION OF
WHENEVER RETURNING RETURNING WHENEVER ABSENT. DOMICILE DOES
NOT INCLUDE A TEMPORARY DWELLING UNLESS THERE IS A PRESENT
INTENTION TO ABANDON PERMANENTLY OR INDEFINITELY THE FORMER
DOMICILE.

11-149.

"Resident" means any person:

(1)    Who is [a legal resident of] DOMICILED IN
this State; OR

(2)    Who owns, maintains, or operates a place of
business in this State and uses motor vehicles intrastate in
that business in this State [;

(3)    Who maintains a temporary residence in this
State and accepts any employment or engages in any trade,
profession, or occupation in this State; or

(4)    Who maintains a temporary or seasonal
residence in this State in excess of 120 cumulative days
during the registration year].
