SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 48A — Insurance Code

354C.

(a) It shall be unlawful for any corporation required
to be licensed under any section of this subtitle and
maintaining or operating a nonprofit health service plan to
do or cause to be done, directly or indirectly, any of the
following acts:

(VI) TO FAIL TO NOTIFY IN WRITING A CLAIMANT OF

THE DENIAL OR APPROVAL OF A PROPERLY COMPLETED CLAIM WITHIN

60 DAYS OF RECEIPT MADE BY ANY PERSON UNDER A CONTRACT,

CERTIFICATE, OR POLICY UNDER A NONPROFIT HEALTH SERVICE

PLAN. (VI) TO FAIL TO NOTIFY IN WRITING ANY MEMBER OF A

NONPROFIT___HEALTH SERVICE PLAN OF THE ANY DENIAL OR APPROVAL

OF HIS PROPERLY COMPLETED CLAIM WITHIN 60 DAYS OF RECEIPT BY
THE CORPORATION OF THE CLAIM.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
