(E) WITH THE CONSENT OF THE ATTORNEY GENERAL, THE
ADMINISTRATOR SHALL WITHDRAW MAY REMOVE OBSOLETE REGULATIONS
OR PARTS OF REGULATIONS FROM THE CODE OF MARYLAND

REGULATIONS WHEN:

(1)    THE REGULATIONS ARE DECLARED
UNCONSTITUTIONAL BY A COURT OF FINAL APPEAL; OR

(2)    THE PROMULGATING ADOPTING AGENCY CEASES TO
EXIST AND THE REGULATIONS ARE NOT TRANSFERRED TO A SUCCESSOR
AGENCY UNDER ARTICLE 41, §8.

256-I.

(E) WHEN A REGULATION, IN WHOLE OR IN PART, IS

DECLARED INVALID AND UNCONSTITUTIONAL BY A COURT OF FINAL

APPEAL, THE ADOPTING AGENCY SHALL GIVE NOTICE TO THAT EFFECT
IN THE REGISTER. THE ADMINISTRATOR ALSO SHALL GIVE NOTICE
IN THE CODE OF MARYLAND REGULATIONS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act

shall take effect July 1, 1978.
