9.

(5) (a) Creditable service at retirement on which
the retirement allowance of a member shall be based shall
consist of the membership service rendered by him since he
last became a member and [.also, if he has a prior service
certificate which is in full force and effect, the period of
the] service certified [on his] AS prior service
[certificate].

[In addition, any person who at any time had previous
State service with membership in the Maryland State Police
Pension Fund shall be credited with such service for
creditable service purposes.]

(B) CREDIT MAY BE REGAINED IF A MEMBER DEPOSITS
IN THE RETIREMENT SYSTEM THE ACCUMULATED CONTRIBUTIONS
PREVIOUSLY WITHDRAWN FROM THE EMPLOYEES' RETIREMENT SYSTEM,
THE TEACHERS' RETIREMENT SYSTEM, OR THE STATE POLICE
RETIREMENT SYSTEM, IN A LUMP SUM AND WITH INTEREST TO DATE
OF DEPOSIT, ON CONDITION THAT THE MEMBER MAY NOT RETIRE
WITHIN 3 YEARS AFTER THE DATE OF ENTRY INTO THE RETIREMENT
SYSTEM, EXCEPT THAT THE 3-YEAR CONDITION DOES NOT APPLY TO
RETIREMENT DUE TO DISABILITY.

[(b) (i) ] (6) (A) Upon verification to the board
of trustees a member at the time of retirement shall receive
membership service for unused sick leave in accordance with
the formula that 22 days of unused sick leave are equal to
one month of membership service. One additional month of
membership service shall be granted if fractional days
totaling 11 or more result from the application of this
formula.

[(ii)] (B) for the purpose of this [section]
PARAGRAPH, no more than 15 days of sick leave of any member
may be accumulated annually.

[ (iii) ] (C) For the purposes of this [section]
PARAGRAPH, if an employer provides an annual sick leave
allowance in excess of 15 days, the days of sick leave
actually used in any year shall first be charged against
accumulated leave to the extent of the excess.

[(iv)] (D) Sick leave membership services shall
not be used to determine years of membership service
required for the following:

(1)    Death benefit;

(2)    Ordinary disability;

(3)    Vesting of employer contributions;

(4) Early retirement; or
