SPECIAL NEEDS OF ELDERLY AND HANDICAPPED PERSONS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning

Unauthorized Duplication of Sound Recordings

FOR the purpose of prohibiting the unauthorized duplication,
sale, distribution of sound recordings, and the
unauthorized recording of live performances, before an
audience or transmitted by any means; exempting certain
persons; providing for the forfeiture and destruction
of certain articles; and generally relating to the
unauthorized copying, recording and sale of sound
recordings.

BY repealing and reenacting, with amendments,

Annotated Code of Maryland

(1976 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

467A.

(a) Unless [exempt under subsection (c),] OTHERWISE
PROVIDED IN THIS SECTION, it is unlawful for any person,
firm, partnership, corporation, or association knowingly to:

(1) Transfer or cause to be transferred any
sounds recorded on a phonograph record, disc, wire, tape,
film, or other article on which sounds are recorded onto any
other phonograph record, disc, wire, tape, film, or article
WITH THE INTENT TO SELL OR CAUSE TO BE SOLD FOR PROFIT OR
USED TO PROMOTE THE SALE OF ANY PRODUCT, WITHOUT THE CONSENT
OF THE OWNER OF THE ORIGINAL FIXATION OF SOUNDS EMBODIED IN
THE MASTER RECORDING, FILM, OR OTHER SUCH ARTICLE; or
