AN ACT concerning

State Wetlands - Appeals

FOR the purpose of providing for judicial appeal from a
decision of the Board of Public Works on an application
for a license to dredge or fill on State wetlands;
where the appeal shall be filed; time for filing the
appeal; and that the appeal shall be on the record
below.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article — Natural Resources

9-203.

ANY PARTY TO THE PROCEEDINGS AGGRIEVED BY THE DECISION
OF THE BOARD, MAY PETITION THE CIRCUIT COURT IN THE COUNTY
WHERE THE LAND IS LOCATED WITHIN 30 DAYS AFTER RECEIVING THE
DECISION. THE APPEAL SHALL BE HEARD ON THE RECORD COMPILED
BEFORE THE BOARD.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
