COUNTY IN WHICH THE SALE, LEASE, OR DISPOSAL OCCURRED, IF
THE PUBLIC SCHOOL BUILDING WAS:

(I)    CONSTRUCTED UNDER A CONTRACT EXECUTED ON OR
AFTER FEBRUARY 1, 1971; AND

(II)   PAID FOR PRIMARILY WITH STATE FUNDS UNDER
THIS SECTION.

(3) THE PART OF THE PROCEEDS FROM THE SALE,
LEASE, OR DISPOSAL OF A PUBLIC SCHOOL BUILDING THAT FAIRLY
REPRESENTS THE APPRAISED VALUE OF LAND AND THAT PART OF THE
COST OF THE PUBLIC SCHOOL BUILDING THAT WAS FUNDED BY THE
COUNTY SHALL REMAIN AS THE FUNDS OF THE COUNTY.

(K) APPROPRIATIONS TO BE SEPARATE FUND.

WHETHER BY BUDGET BILL OR SUPPLEMENTARY APPROPRIATION
BILL, ALL MONEY APPROPRIATED TO CARRY OUT THE PURPOSES OF
THIS SECTION IS A SEPARATE FUND WHICH THAT SHALL BE
ADMINISTERED BY THE STATE COMPTROLLER IN ACCORDANCE WITH THE
RULES AND REGULATIONS ADOPTED BY THE BOARD OF PUBLIC WORKS.

REVISOR'S NOTE:      This section presently appears as the

second and third sentences of Art. 77,

§130 (b)(2) and Art. 77, §130A(e) and (c) through
(i).

Present Art. 77, §130A(b) is deleted as obsolete.

Throughout this section, the present references
to "Baltimore City" and "the Board of School
Commissioners of Baltimore City" are deleted in
light of the definitions of "county" and "county
boards" in §1—101 of this article.

The only other changes are in style.

The balance of Art. 77, §130 is deleted as
obsolete.

5-302. INTERAGENCY COMMITTEE ON SCHOOL CONSTRUCTION.

(A)   UNIT IN DEPARTMENT.

THE INTERAGENCY COMMITTEE ON SCHOOL CONSTRUCTION
ESTABLISHED BY THE BOARD OF PUBLIC WORKS IS A UNIT WITHIN
THE DEPARTMENT FOR ADMINISTRATIVE AND BUDGETARY PURPOSES.

(B)   STAFF.

(1)   THE DEPARTMENT OR ANY OTHER STATE AGENCY MAY
LEND ITS EMPLOYEES TO SERVE AS THE STAFF FOR THE INTERAGENCY
COMMITTEE.

(2)    THESE EMPLOYEES SHALL BE PAID BY THE AGENCY

THAT EMPLOYS THEM.
