(a) (1) In this section the following words have
the meanings indicated.

(2) "Gas appliance" means any new residential

type furnace, air conditioner, heater, refrigerator, stove,

range, dishwasher, dryer,__decorative fireplace log, or other

similar device, except a water heater which uses a gaseous
fuel for operation and is automatically ignited.

(3) "Intermittent ignition device" means an

ignition device which is actuated only when the gas

appliance is in operation.

(4) "Pilot light" means any gas operated device
that remains continually operated or lighted in order to
ignite a gas appliance to begin normal operation.

(5) "Person" includes an individual,

corporation, business trust, estate, trust, partnership,

association, two or more persons having a joint or common
interest, or any other legal or commercial entity.

(6) "Commission" means the Public Service
Commission.

(b) (1) The Commission, on or before [January] JULY
1, 1979, shall develop in cooperation with affected industry

and consumer representatives, the specifications for

certification of intermittent ignition devices. The

specifications shall;

(i) Result in the conservation of primary
energy resources;

(ii) Not significantly affect the price of

gas appliances in competition with similar electrical

appliances;

(iii) Give due consideration to the initial
costs including installation;

(ix) Give due consideration to maintenance
costs imposed upon the consumer; and

(v) Include__provisions necessary for

public health and safety.

(2) The Commission may determine, after
demonstration, that there is no feasible alternative means
to the use of a pilot light or that the use of a pilot light
is necessary for public health and safety.

(c) Within 90 days after an intermittent ignition

device has been certified by the Commission, the Commission
