SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 78 - Public Service Commission Law

54F.

(A)    (1) IN THIS SECTION THE FOLLOWING WORDS HAVE
THE MEANINGS INDICATED.

(2)    "APARTMENT HOUSE" MEANS A BUILDING OR
BUILDINGS CONTAINING MORE THAN TWO DWELLING UNITS ALL OF
WHICH ARE RENTED PRIMARILY FOR NONTRANSIENT USE, WITH RENTAL
PAID AT INTERVALS OF ONE WEEK OR LONGER. THE TERM INCLUDES
RESIDENTIAL CONDOMINIUMS AND COOPERATIVES, WHETHER RENTED OR
OWNER OCCUPIED.

(3)    "DWELLING UNIT" MEANS A ROOM OR ROOMS
SUITABLE FOR OCCUPANCY AS A RESIDENCE CONTAINING KITCHEN AND
BATHROOM FACILITIES.

(4) "SUBMETERING" MEANS THE INSTALLATION OF

EQUIPMENT FOR THE PURPOSE OF DETERMINING THE ACTUAL USE OF

ELECTRICITY PER RESIDENTIAL UNIT IN APARTMENT HOUSES__AS

DEFINED IN (A)(2) OF THIS SECTION.

(B)    NOTWITHSTANDING ANY LAW TO THE CONTRARY, THE
PUBLIC SERVICE COMMISSION SHALL PROMULGATE RULES,
REGULATIONS, AND STANDARDS UNDER WHICH ANY OWNER, OPERATOR,
OR MANAGER OF AN APARTMENT HOUSE WHICH IS NOT INDIVIDUALLY
METERED FOR ELECTRICITY FOR EACH DWELLING UNIT MAY INSTALL
SUBMETERING EQUIPMENT FOR EACH INDIVIDUAL DWELLING UNIT FOR
THE PURPOSE OF FAIRLY ALLOCATING THE COST OF EACH INDIVIDUAL
DWELLING UNIT'S ELECTRICAL CONSUMPTION. EXCEPT IN UNITS

CONSTRUCTED,__MANAGED, OPERATED, DEVELOPED, OR SUBSIDIZED BY

A LOCAL HOUSING AUTHORITY AS ESTABLISHED UNDER ARTICLE 44A,
IF, DURING THE TERM OF ANY LEASE OR AGREEMENT WHICH INCLUDES
THE COST OF ELECTRICITY CONSUMED FOR THE DWELLING UNIT, THE
