AN ACT concerning

Minimum Wage Law - Exemption

FOR the purpose of exempting from the overtime provisions of
the Minimum Wage Law certain employees primarily
engaged in furnishing part-time temporary at home care
services to certain persons.

BY adding to

Article 100 - Work, Labor and Employment
Section 83 (3) (i)
Annotated Code of Maryland
(1964 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 100 - Work, Labor and Employment

83.

(3) All employees as may be subject to the provisions
of this subtitle shall receive a wage of one and one—half(1
1/2) times their usual hourly wage rate for any hours worked
in excess of forty (40) hours during any work week except
that this subsection shall not apply to any of the following
employees:

(I) ANY EMPLOYEE WHO IS EMPLOYED BY A NONPROFIT
EMPLOYER AND IS PRIMARILY ENGAGED IN THE FURNISHING OF
PART-TIME TEMPORARY AT HOME CARE SERVICES SUCH AS DELIVERY
OF PREPARED MEALS, COMPANIONSHIP AND OTHER RELATED SERVICES
TO THE SICK, THE AGED, OR THE MENTALLY ILL, THE HANDICAPPED,
OR DISABLED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
