5-106. APPROPRIATIONS AND EXPENDITURES FOR CAPITAL
PROJECTS.

(A)       BALTIMORE CITY EXCEPTED.

THIS SECTION DOES NOT APPLY TO BALTIMORE CITY.

(B)   APPROPRIATIONS OF LESS THAN AMOUNT REQUESTED.

IF THE COUNTY COMMISSIONERS OR COUNTY COUNCIL DOES NOT
APPROPRIATE THE AMOUNT REQUESTED BY THE COUNTY BOARD FOR
CAPITAL PROJECTS, IT SHALL INDICATE IN WRITING WHICH
PROJECTS HAVE BEEN REDUCED, DEFERRED, OR ELIMINATED AND THE
REASON FOR THE REDUCTION, DEFERRAL, OR ELIMINATION.

(C)   EXPENDITURE FOR SCHOOL BUILDING CONSTRUCTION.

(1)     THE EXPENDITURE FOR SCHOOL BUILDING
CONSTRUCTION SHALL BE MADE IN ACCORDANCE WITH THE COST
APPROVED BY THE COUNTY COMMISSIONERS OR COUNTY COUNCIL FOR
EACH PROJECT.

(2)   A TRANSFER BETWEEN MAJOR CATEGORIES OR OF
UNEXPENDED PROJECT BALANCES IS SUBJECT TO THE APPROVAL OF
THE COUNTY COMMISSIONERS OR COUNTY COUNCIL.

(3)    IF THE COUNTY COMMISSIONERS OR COUNTY
COUNCIL DOES NOT TAKE ACTION ON A TRANSFER WITHIN 30 DAYS
AFTER THE RECEIPT OF A WRITTEN REQUEST SUBSTANTIATING THE
TRANSFER, THE FAILURE TO TAKE ACTION CONSTITUTES APPROVAL.

REVISOR'S NOTE: This section presently appears as Art.
77, §117(f).

Subsection (a) of this section is new language
added to except Baltimore City as expenditures
and transfers in Baltimore City are controlled by
its Charter and since it appears to be the
statutory intent.

The only other changes are in style.

5-107. BUDGETARY REQUIREMENTS — BALTIMORE CITY.

(A)   COPY OF BUDGET TO STATE SUPERINTENDENT.

A COPY OF THE BUDGET AS APPROVED BY THE MAYOR AND CITY
COUNCIL OF BALTIMORE CITY SHALL BE SUBMITTED TO THE STATE
SUPERINTENDENT WITHIN 30 DAYS AFTER APPROVAL.

(B)    AMOUNT OF BUDGET TO BE NOT LESS THAN REQUIRED BY
§5-202.
