County Council restoration authority, was added
by Ch. 623, Acts of 1977. This restoration
authority is subject to a presently uncodified
contingency, that the voters of Baltimore County
approve a charter amendment. This uncodified
provision, which presently appears as Section 2
of Ch. 623, is codified as the first sentence of
subsection (c) (5) of this section. The
recodification of both subsections (c) (4) and (5)
clarifies the present law.

The only other changes are in style.

5-103, BUDGET AMOUNT.

(A)       BALTIMORE CITY EXCEPTED.

THIS SECTION DOES NOT APPLY TO BALTIMORE CITY.

(B)       AMOUNT TO BE NOT LESS THAN REQUIRED BY §5-202.

THE AMOUNT REQUESTED IN THE ANNUAL BUDGET OF EACH
COUNTY BOARD FOR CURRENT EXPENSES FOR THE NEXT SCHOOL YEAR
AND THAT IS TO BE RAISED BY REVENUE FROM LOCAL SOURCES MAY
NOT BE LESS THAN THE MINIMUM AMOUNT REQUIRED TO BE LEVIED
UNDER §5-202 OF THIS TITLE.

(C)       COUNTY GOVERNING BODY COMMISSIONERS OR COUNTY

COUNCIL MAY PROVIDE FOR ADDITIONAL FUNDS.

THE COUNTY GOVERNING BODY COMMISSIONERS OR COUNTY

COUNCIL MAY PROVIDE FUNDS THAT ARE MORE THAN THE AMOUNT
REQUIRED BY §5-202 OF THIS TITLE TO SUPPORT IMPROVED AND
ADDITIONAL PROGRAMS.

(D)      CATEGORIES AND REASONS FOR REDUCTION OF ADDITIONAL
FUNDS.

IF A COUNTY GOVERNING BODY COUNCIL OR BOARD OF COUNTY
COMMISSIONERS DOES NOT APPROVE THE AMOUNT REQUESTED IN THE
BUDGET THAT IS MORE THAN THE AMOUNT REQUIRED BY §5-202 OF
THIS TITLE, IT SHALL INDICATE IN WRITING, WITHIN 15 DAYS
AFTER THE ADOPTION OF THE BUDGET, WHICH MAJOR CATEGORIES OF
THE ANNUAL BUDGET HAVE BEEN REDUCED AND THE REASON FOR THE
REDUCTION.

REVISOR'S NOTE: This section presently appears as Art.
77, §117(c).

Subsection (a) of this section is new language
added to except Baltimore City as §5-107 of this
subtitle contains similar provisions for

Baltimore City.

In subsection (b) of this section, the reference
to the "Board of School Commissioners of
Baltimore City" is deleted as unnecessary in
light of the addition of subsection (a) of this
