appliances and surgical appliances when the same are
designed to be worn on the person of the owner or user when
prescribed by a physician, the sales of colostomy and
ileostomy appliances, and the sales of wheelchairs for
invalids, hospital beds, oxygen tents, and other sick room
equipment as may be defined by regulations of the
Comptroller.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning

Leased Oyster Bottoms — Alteration
of Buoys, Stakes, and Monuments

FOR the purpose of prohibiting certain persons from
destroying stakes, buoys, or monuments on leased oyster
bottoms; providing a penalty; and providing that, in
any action at law involving an alleged trespasser on
certain leased oyster beds, a court may not impose a

penalty under certain circumstances;__and relating

generally to the alteration, transfer, or destruction

of buoys, stakes, and monuments on leased oyster

bottoms.

BY repealing and reenacting, with amendments,

Section 4-1113 and 4-1118(b)
Annotated Code of Maryland
(1974 Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Natural Resources

4-1113.

Immediately upon entering into a lease, every lessee,

shall designate leased oyster bottoms by plainly marking

them with stakes, buoys, or monuments, under the supervision

of the department. The initials of the lessee shall be

marked on at least four stakes, buoys, or monuments.
