REPRESENTATIVE A REASONABLE WRITTEN EXPLANATION FOR ANY

HOSPITAL OR NURSING HOME TO A FINE OF $300.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning

Surface Mining - Exemption for Landfills
Public Facilities

FOR the purpose of exempting     cover material for public

disposal areas or landfills facilities under__certain

circumstances from certain     requirements relating to
surface mining.

BY repealing and reenacting, with amendments,

Article - Natural Resources

Section 7-6A31 Section 7-6A01(u)(2)(viii) and 7-6A31

Annotated Code of Maryland

(197ft Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article — Natural Resources

7-6A01.

(u) (2) (viii) The extraction of sand, gravel,

rock, stone, earth, or fill from__borrow pits for highway

construction purposes OR OTHER PUBLIC FACILITIES, if the

work is performed under a bond, contract, and specifications
of the Department which provide for and require reclamation

of the area affected in the manner provided by this

subtitle; or

7-6A31.

(a) (1) The provisions of this subtitle do     not

apply to activities of the State Highway Administration,    any

county roads department in the State, any

legally-constituted public governing entities such as
