SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 41 - Governor — Executive and Administrative
Departments

STATEWIDE BUILDING ENERGY UTILIZATION STANDARD GUIDELINES

257M.

(A) (1) IN THIS SECTION THE FOLLOWING TERMS HAVE
THE MEANINGS INDICATED.

(2) "ASHRAE" MEANS THE ORGANIZATION KNOWN AS
THE AMERICAN SOCIETY OF HEATING, REFRIGERATING, AND AIR
CONDITIONING ENGINEERS.

          (3) "BUILDING" MEANS ANY STRUCTURE USED OR

INTENDED FOR SUPPORTING OR SHELTERING ANY USE OR OCCUPANCY,

INCLUDING ASSEMBLY, BUSINESS, FACTORY, INDUSTRIAL,

INSTITUTIONAL,--MERCANTILE, STORAGE, AND RESIDENTIAL USES OR

OCCUPANCIES. THE TERM DOES NOT INCLUDE FARM BUILDINGS WHICH

ARE NOT INTENDED FOR HUMAN OCCUPANCY.

(4) (3) "DEPARTMENT" MEANS THE DEPARTMENT OF
ECONOMIC AND COMMUNITY DEVELOPMENT.

(5) (4) "SECRETARY" MEANS SECRETARY OF THE
DEPARTMENT OF ECONOMIC AND COMMUNITY DEVELOPMENT.

(B) (1) THE DEPARTMENT OF ECONOMIC AND COMMUNITY

DEVELOPMENT, OR THE APPROPRIATE DIVISION THEREOF, SHALL

PROMULGATE AND ADOPT DEVELOP A STATEWIDE ENERGY UTILIZATION
STANDARD GUIDELINES THAT IS APPLICABLE TO ALL NEW BUILDINGS
FOR WHICH A BUILDING OR ZONING PERMIT IS ISSUED AND NOT
EXEMPTED BY THE LOCAL JURISDICTIONS.

(2) IN DEVELOPING THE STATE STANDARD
GUIDELINES, THE DEPARTMENT SHALL UTILIZE THE MOST RECENT
ASHRAE STANDARD, "ENERGY CONSERVATION IN NEW BUILDING

DESIGN". HOWEVER, THE DEPARTMENT MAY MAKE EXCEPTIONS OR

MODIFICATIONS WHICH, AFTER ADEQUATE PUBLIC NOTICE AND PUBLIC
HEARING, IT DEEMS APPROPRIATE.

(3) THE DEPARTMENT ALSO MAY MODIFY THE STATE

STANDARD TO CONFORM WITH THE NATIONAL ENERGY CONSERVATION

STANDARD IMPOSED ON STATE BUILDING CODES BY THE DEPARTMENT

OF HOUSING AND URBAN DEVELOPMENT PURSUANT TO THE

PRODUCTION ACT OF 1976.

(3) AFTER APPROVAL BY THE AELR COMMITTEE OF THE
MARYLAND GENERAL ASSEMBLY. THESE GUIDELINES WILL BE

PROMULGATED. BASED ON THE STATE GUIDELINES. AS APPROVED BY

THE AELR COMMITTEE, EACH LOCAL JURISDICTION SHALL REQUIRE
