HORSEPOWER OR LESS AND, IF THE MOTOR IS AN INTERNAL
COMBUSTION ENGINE, A CAPACITY OF 50 CUBIC CENTIMETERS PISTON
DISPLACEMENT OR LESS.

(a)    "Motorcycle" means a motor vehicle that:

(1)    Has two or three wheels;

(2)    Has a motor with a rating of more than
[one] 1.5 brake horsepower [or] AND a capacity of more than
[50] 74 cubic centimeters piston displacement;

(3)    Has a singular front steering road wheel
mounted in a fork assembly that passes through a frame
steering bearing and to which is attached a handlebar or
other directly operated steering device;

(4)    Has a seat that is straddled by the driver;
and

(5)    Except for a windshield or windscreen, does
not have any enclosure or provision for an enclosure for the
driver or any passenger.

13-406. 1.

A MOTOR VEHICLE WHICH PRIOR TO JULY 1, 1978 IS

REGISTERED AS A MOTORCYCLE AND WHICH HAS A MOTOR WITH LESS
THAN 75 CUBIC CENTIMETERS PISTON DISPLACEMENT SHALL CONTINUE
TO BE REGISTERED AS A MOTORCYCLE.

(b)        Each individual operating on any highway in this
State a bicycle that is equipped with an assisting motor, as
described in [§ 11-104(1)(ii)] 11-134.1 of this article,
shall have with him:

(1)        A driver's license issued to him under this
title, which license may be of any class issued by the
Administration; [or]

(2)        If he is a nonresident of this State, a
license to drive issued to him by the state or country of
his residence, which license may be for any class of
vehicle[.]; OR

(3)         A MOPED OPERATOR'S PERMIT ISSUED TO HIM
UNDER THIS SUBTITLE.
