WHENEVER A          PHYSICIAN,           CHIROPRACTOR,          DENTIST,

PODIATRIST, OPTOMETRIST, PHARMACIST, NORSE, OPTICIAN, OR
OTHER HEALTH PRACTITIONER LICENSED OR CERTIFIED IN THIS
STATE IS CONVICTED OF FRAUD IN CONNECTION WITH THE MARYLAND
MEDICAL ASSISTANCE PROGRAM, THE PHYSICIAN OR OTHER
PRACTITIONER MAY NOT BE ELIGIBLE FOR ANY FURTHER PAYMENTS
UNDER THE MARYLAND MEDICAL ASSISTANCE PROGRAM. HOWEVER, THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE MAY REINSTATE A
PHYSICIAN OR OTHER PRACTITIONER IF THE SECRETARY DETERMINES

THAT SUCH DENIAL OF PARTICIPATION COULD RESULT IN DEPRIVING

MEDICAL ASSISTANCE RECIPIENTS OF NEEDED HEALTH CARE SERVICES
IN A MEDICALLY UNDERSERVED AREA.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article — Commercial Law

15-102.

(b) The property of an insolvent who makes an
assignment for the benefit of creditors or who has his
property taken by a receiver under a decree of a court in an
