SECTION 2. AND BE IT FURTHER ENACTED, That this Act

AN ACT concerning

State Treasurer — Claims

FOR the purpose of deleting the provisions that, in certain
instances, enable or require the State Treasurer to
withhold money from certain claimants demanding against
the State.

BY repealing

Article 95 - Treasurer

Section 9 and 10

Annotated Code of Maryland

(1969 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 95 — Treasurer

[9.

The Treasurer, upon demand being made upon him by any
person or corporate body having a claim against the State
due to him or it in his or its own right shall, if such
person or corporation is indebted to this State upon the
books of the Treasury to an amount less than the sum so due
and claimed, deduct the sum so due the State from the amount
demanded and pay the difference only; and if the amount due
to the State shall be equal to or exceed the sura so
demanded, the Treasurer shall withhold the entire amount.

10.

If the demand is made by any assignee of a party having
a claim against the State, the same right to withhold or
deduct, as the case may be, shall exist as if the demand
were made by the assignor.]
