BY repealing and reenacting, with amendments,

Article 27 — Crimes and Punishments

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

461.

(b) "Mentally defective" means a victim who suffers

from a mental disorder OR RETARDATION which permanently or

temporarily MEANS (1) A VICTIM WHO SUFFERS FROM MENTAL

RETARDATION, OR (2) A VICTIM WHO SUFFERS FROM A TEMPORARY OR
PERMANENT MENTAL DISORDER, EITHER OF WHICH TEMPORARILY OR
PERMANENTLY renders the victim substantially incapable of
appraising the nature of his or her conduct, or resisting
the act of vaginal intercourse, a sexual act, or sexual
contact, or of communicating unwillingness to submit to the
act of vaginal intercourse, a sexual act, or sexual contact.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning

Landlord and Tenant — Holding Over

FOR the purpose of permitting the District Court in its
discretion to continue a case for a certain period when
either landlord or tenant fails to appear for the
scheduled hearing; and clarifying certain language.
