(Senate Bill 266)

AN ACT concerning

Charles County — Education
(Removal of Board Members)

FOR the purpose of enumerating reasons for which a member of
the Charles County Board of Education may be removed;
requiring a copy of charges to be sent; extending to
the member the opportunity of being heard publicly in
his own defense; granting a right of review to the
Charles County Circuit Court; requiring that members
continue certain status at the time of their candidacy
and during their term of service; and generally
relating to education in Charles County.

BY repealing and reenacting, with amendments,

Article - Education
Section 3-401(b)(1)
Annotated Code of Maryland

(As enacted by Chapter___of the Acts of the General

Assembly of 1978)

BY adding to

Article - Education

Section 3-101(e)

Annotated Code of Maryland

(As enacted by Chapter___of the Acts of the General

Assembly of 1978)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter___of the Acts of the General Assembly

of 1978) be repealed, amended, or enacted to read as
follows:

Article — Education

3-401.

(b) (1)        An individual nominated for membership on

the county board  shall be a resident and registered voter of

Charles County.      ANY MEMBER WHO NO LONGER RESIDES IN CHARLES

COUNTY OR WHO     IS NOT A REGISTERED VOTER OF CHARLES COUNTY

MAY NOT CONTINUE   AS A MEMBER OF THE BOARD.

(E) (1) WITH THE APPROVAL OF THE GOVERNOR, THE
STATE BOARD MAY REMOVE A MEMBER OF THE COUNTY BOARD FOR ANY
OF THE FOLLOWING REASONS:
