4-112. SCHOOL CENSUS AND CENSUS OF HANDICAPPED CHILDREN.

(A)   CENSUS AUTHORIZED.

UNDER THE DIRECTION OF THE COUNTY SUPERINTENDENT, A
COUNTY BOARD MAY TAKE A SCHOOL CENSUS OF THE CHILDREN UNDER
THE AGE OF 18 IN ITS COUNTY, INCLUDING A CENSUS OF
HANDICAPPED CHILDREN BOTH OF SCHOOL AGE AND OF PRESCHOOL
AGE.

(B)   DATA.

ANY DATA COLLECTED AS TO HANDICAPPED CHILDREN SHALL BE
FURNISHED TO THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE.

(C)   WITHHOLDING INFORMATION PROHIBITED.

ANY PERSON WHO HAS UNDER HIS CONTROL A CHILD UNDER THE
AGE OF 18 AND WHO WITHHOLDS INFORMATION NEEDED FOR THE
CENSUS FROM ANY OFFICES DEMANDING IT OR WHO MAKES ANY FALSE
STATEMENT ABOUT THE CHILD IS GUILTY OF A MISDEMEANOR AND ON
CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $20.

REVISOR'S NOTE: This section presently appears as Art.
77, §56.

In subsection (a) of this section, the present
references to "the Board of School Commissioners
of Baltimore City" and "the superintendent of
public instruction of Baltimore City" are deleted
as unnecessary in light of the definitions of
"county board" and "county superintendent" in
§1-101 of this article.

The only other changes are in style.

As to further requirements for the identification
and reporting of handicapped children, see §8—411
of this article.

4-113. SCHOOL PROPERTY HELD IN TRUST BY COUNTY BOARD; TAX
EXEMPTIONS.

(A) PROPERTY TO BE HELD IN TRUST AND TAX EXEMPT.

ALL PROPERTY GRANTED, CONVEYED, DEVISED, OR BEQUEATHED
FOR THE USE OF A PARTICULAR PUBLIC SCHOOL OR SCHOOL SYSTEM:

(1) SHALL BE HELD IN TRUST FOR THE BENEFIT OF
THE SCHOOL OR SCHOOL SYSTEM BY THE APPROPRIATE COUNTY BOARD
OR, IN BALTIMORE CITY, BY THE MAYOR AND CITY COUNCIL; AND
