PUBLIC INSTRUCTION IS THE EXECUTIVE OFFICER AND SECRETARY OF
THE BOARD OF SCHOOL COMMISSIONERS.

(3) A COUNTY SUPERINTENDENT IS NOT A PUBLIC
OFFICER UNDER THE CONSTITUTION OR THE LAWS OF THIS STATE,

(B)   ATTENDANCE AT MEETINGS.

UNLESS HIS TENURE OR SALARY OR THE ADMINISTRATION OF
HIS OFFICE IS UNDER CONSIDERATION, THE COUNTY SUPERINTENDENT
OR HIS DESIGNEE SHALL ATTEND ALL MEETINGS OF THE COUNTY
BOARD AND ITS COMMITTEES.

(C)   ADVICE.

THE COUNTY SUPERINTENDENT MAY ADVISE ON ANY QUESTION
UNDER CONSIDERATION BUT MAY NOT VOTE.

REVISOR'S NOTE: This section presently appears as Art.
77, §39.

The only changes are in style.

In this section and throughout this article, the
terms "county superintendent" and "county board",
are substituted for "county superintendent of
schools" and "county board of education"
respectively, in light of the definitions of
"county superintendent" and "county board" in
§1-101 of this article.

Although this section applies to Baltimore City,
the Baltimore City Charter does not provide for a
treasurer of the Board of School Commissioners as
fiscal matters are handled by the Board of
Estimates. Legislation to remedy this situation
appears to be needed.

4-103. SCHOOL PERSONNEL.

(A)   APPOINTMENT AND SALARY.

ON THE WRITTEN RECOMMENDATION OF THE COUNTY
SUPERINTENDENT AND SUBJECT TO THE PROVISIONS OF THIS
ARTICLE, EACH COUNTY BOARD SHALL:

(1)   APPOINT ALL PRINCIPALS, TEACHERS, AND OTHER
CERTIFICATED AND NONCERTIFICATED PERSONNEL; AND

(2)   SET THEIR SALARIES.

(B)   BALTIMORE CITY.

(1)   IN BALTIMORE CITY, THE BOARD OF SCHOOL
COMMISSIONERS SHALL EXERCISE THE AUTHORITY GRANTED IN THIS
SECTION, EXCEPT AS TO NONCERTIFICATED PERSONNEL.

(2)      THE APPOINTMENT AND SALARY OF
