Annotated Code of Maryland

(1972 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 56 - Licenses

148.

(e) (1) Every petroleum transporter, except a
dealer as defined in § 135, shall report monthly, on forms
prescribed by the Comptroller, all gasoline, number 2 fuel
oil, 1-D diesel fuel, and [21D] 2-D diesel fuel products
which the transporter imports into or exports from the State
in any conveyance. All other petroleum products shall be
reported only upon written request of the Comptroller.

153.

Any dealer, person, association for] OF persons, firm
or corporation violating any of the provisions of this
subtitle, or any person, firm or agent of any corporation
who shall make any false statement in connection with an
application for the refund of any money or tax as provided
in this subtitle, or who shall collect or cause to be repaid
to him or to any person any tax without being entitled to
the same under the provisions of this subtitle, shall be
deemed guilty of a misdemeanor and shall be charged and
receive a citation as provided in Title 26 of the
Transportation Article and, upon conviction thereof, shall
be punished by a fine of not more than one thousand dollars
($1,000.00) or by imprisonment in the county jail for not
more than six (6) months, or by both such fine and
imprisonment.

The definitions set forth in § 135 of this article
shall be applicable to this subtitle. In addition, the
following words, terms or phrases are, for purposes hereof,
defined as follows:

(13) "Retail diesel FUEL seller" means a person,
firm, or corporation maintaining a retail place of business
where diesel fuel is sold and delivered into the tanks of
motor vehicles.

(b) Whenever the Comptroller of the Treasury shall find
any person willfully marketing gasoline and special fuel
products in this State which are regulated by this article
and which do not comply with the prescribed minimum
specifications [therefore] THEREFOR or otherwise willfully
marketing petroleum products in violation of this article
