AN ACT concerning

Water Resources — Hearings

FOR the purpose of enabling the Department of Natural
Resources to waive the public hearing requirements on
permit applications for daily appropriation or use of
less than a certain amount of the waters of the State,

BY adding to

Article — Natural Resources
Section 8-806 (d)(6)
Annotated Code of Maryland
(1974 Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Natural Resources

8-806.

(d) The department may waive holding a public hearing
on any permit application under the following conditions:

(6) IF THE REQUESTED APPROPRIATION OR USE OF
WATERS OF THE STATE IS FOR A QUANTITY OF 10,000 GALLONS OR
LESS PER DAY.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
