producer's] A PERSON'S shipment that [is drawn and placed
into an approved container and] MAY BE used for an analysis
of milk components [on which] THAT AFFECTS payment [to the
producer is based] FOR THE MILK OR OTHER FLUID DAIRY
PRODUCTS,
[(h)] (J) (1) "Test" means an official procedure,
approved by the Association of Official Analytical Chemists
or American Public Health Association as published in the
latest edition of [their] ITS official publication and
adopted by the Secretary, which is used to determine the
amount of any milk components in any sample of milk or other
fluid dairy products. [The test]
(2) "TEST" includes the results of the
analysis.
(K) "TRANSFER POINT" MEANS ANY BUILDING, STRUCTURE,
OR LOCATION WHERE MILK OR OTHER FLUID DAIRY PRODUCTS ARE
TRANSFERRED DIRECTLY FROM A MOBILE RECEIVING STATION TO
ANOTHER MOBILE RECEIVING STATION WHILE EN ROUTE FROM THE
PRODUCER TO THE FINAL DESTINATION.

The Secretary may adopt rules and regulations necessary
to regulate receiving, weighing, measuring, sampling, and
testing of milk or other fluid dairy products when the
results [are to] MAY be used as a basis for payment for
these products [when purchased from the producer].
11-404.
(a) A purchaser or hauler [of milk or other fluid
dairy products from the producer or a cooperative
representing a producer, and every cooperative engaged in
making collective sales of or marketing milk or its products
for its members] shall hold, a permit for each receiving
station. However, there shall be only one permit required
for each receiving station and the hauler shall be the
permittee of any mobile receiving station.
(c) Each application for a permit shall be
accompanied by a fee based upon the volume of milk and other
fluid dairy products received AND, IN THE CASE OF A MOBILE
RECEIVING STATION, ITS TOTAL CAPACITY. Permit fees shall be
computed as follows:
Volume Fees
(1) Mobile receiving station of a
capacity not exceeding 5,000 gallons [$10] $15 $10
(2) Mobile receiving station of a
capacity exceeding 5,000 gallons $25
(3) Stationary receiving station for
receiving milk and other fluid dairy products
