OFFICIAL ACT.
UNLESS THE CONTRARY IS ESTABLISHED BY COMPETENT
EVIDENCE, IF A TRAFFIC CONTROL DEVICE IS PLACED IN A
POSITION APPROXIMATELY MEETING THE REQUIREMENTS OF THE
MARYLAND VEHICLE LAM, THE DEVICE IS PRESUMED TO HAVE BEEN
PLACED BY THE OFFICIAL ACT OR DIRECTION OF LAWFUL
AUTHORITY.
(D) PRESUMPTION THAT DEVICES COMPLY WITH
REQUIREMENTS OF VEHICLE LAWS.
UNLESS THE CONTRARY IS ESTABLISHED BY COMPETENT
EVIDENCE, IF A TRAFFIC CONTROL DEVICE IS PLACED IN
ACCORDANCE WITH THE MARYLAND VEHICLE LAW AND PURPORTS
TO MEET THE LAWFUL REQUIREMENTS GOVERNING THESE
DEVICES, THE DEVICE IS PRESUMED TO MEET THE REQUIREMENTS
OF THE MARYLAND VEHICLE LAW.
REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §11-201.
Throughout this section and this subtitle, the
short title "Maryland Vehicle Law" is
substituted for the present references to
"this article"; see §11—206 of this article.
Also, the term "traffic control device" is
substituted for "official traffic-control
device"; see §11—167 of this article.
In subsection (a) of this section, the term
"emergency vehicle" is substituted for
"authorized emergency vehicle"; see §11—118 of
this article. As to the exception granted the
drivers of these vehicles, see §21—106 of this
title.
Also in subsection (a), the present reference
to a "traffic ... officer" is deleted as an
unnecessarily confusing synonym for the term
"police officer", as defined in §11—147 of
this article.
Subsection (b) of this section is revised to
clarify and assure its applicability to
ordinances and regulations of local
authorities as well, such as those adopted
under §25—102(a) of this article and requiring
traffic control devices under §25-102(c).
The only other changes are in style.
