INVOLVED IN THE ACCIDENT. IN THAT CASE, THE OWNER SHALL
REPORT THE MATTER AND FILE THE EVIDENCE OF INSURANCE AS
REQUIRED OF THE DRIVER.
(C) SUPPLEMENTAL REPORTS.
THE ADMINISTRATION MAY REQUIRE THE DRIVER OR OWNER
OF THE VEHICLE TO FILE SUPPLEMENTAL WRITTEN REPORTS IF,
IN ITS OPINION, THE ORIGINAL REPORT IS INSUFFICIENT.
(D) EXCEPTIONS.
A WRITTEN ACCIDENT REPORT IS NOT REQUIRED UNDER THIS
SECTION:
(1) IF THE ACCIDENT HAS BEEN INVESTIGATED BY
A POLICE OFFICER AND A REPORT BY THE POLICE OFFICER HAS
BEEN FILED WITH THE MARYLAND STATE POLICE; OR
(2) FROM ANY PERSON WHILE THAT PERSON IS
PHYSICALLY INCAPABLE OF MAKING THE REPORT.
REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §§ 10-107 and 10-110.
The present references to the driver of a
"motor vehicle" are corrected to refer to any
"vehicle". This conforms to the balance of
this title and corrects an apparent oversight.
Although the change would include bicycles and
horse—drawn vehicles, for example, within the
scope of this section, it is not in any way
intended to affect the insurance requirements
or lack of requirements for these vehicles.
Throughout subsection (a) of this section,
references are added to "other security" to
conform more closely with the requirements of
Title 17 of this article. Cf., §17-103(a) of
this article.
In subsection (a)(1) of this section, the
present phrase "and/or owner" is deleted and,
in subsection (c) of this section, the present
phrase "and/or owner" is replaced with the
term "or owner". The deleted phrases were
first enacted by Ch. 629, Acts of 1970, to
amend prior Art. 66 1/2, §120, which had no
provision for reports by owners. However, the
bulk revision of Art. 66 1/2 during the same
year (Ch. 534, Acts of 1970) repealed prior
§120 and enacted in its stead present §10—107,
including- in it the somewhat different,
conditional provisions that now appear in
subsection (b) of this section for reports by
owners. In an attempt to comply with the
requirements of Section 2 of Ch. 534, Acts of
1970, the phrases were inserted by the
