REVISOR'S NOTE: Items (1) and (2) of this section
are new language derived from the first
sentence of Art. 66 1/2, §5—501, which applies
to "any license issued under the provisions of
this {title}".
Item (3) of this section is new language
derived from the second sentence of Art. 66
1/2, §5—501. Although that sentence literally
applies only to dealer's licenses, it is
placed in this title and revised to
standardize, in accordance with current
practice, these provisions as to all licenses.
(See, e.g., Art. 66 1/2, §5-808 which contains
almost identical provisions as to title
service agencies.)
Present, overly broad references to violations
of "this article" are clarified to refer to
violations of either "this title" or those
provisions of the Maryland Vehicle Law {see,
§11-206 of this article} "that relate to the
business or activity of the person". As
presently worded, a simple speeding violation
- which is a violation of "this article" —
could be construed as grounds for revocation
of a business license.
15-110. HEARINGS ON REFUSAL, SUSPENSION, OR REVOCATION
OF LICENSE.
(A) REFUSAL OF LICENSE.
IF THE ADMINISTRATION REFUSES AN APPLICATION FOR A
LICENSE OR FOR THE RENEWAL OF A LICENSE UNDER THIS TITLE,
THE APPLICANT MAY REQUEST A HEARING UNDER TITLE 12,
SUBTITLE 2 OF THIS ARTICLE.
(B) SUSPENSION OR REVOCATION OF LICENSE.
THE ADMINISTRATION MAY SUSPEND OR REVOKE A LICENSE
ISSUED UNDER THIS TITLE ONLY AFTER A HEARING UNDER TITLE
12, SUBTITLE 2 OF THIS ARTICLE.
REVISOR'S NOTE: This section is new language that
combines without substantive change the common
hearing provisions presently repeated in each
of Art. 66 1/2, §§5-502, 5-602, 5-707, 5-808,
6-505, and 6-706.
In subsection (a) of this section, the phrase
"or for the renewal of a license" is added for
clarity.
In subsection (b) of this section, present
references to the authority of the
Administration to suspend or revoke "the
