820 LAWS OF MARYLAND
The vehicles described in subsection (a) of
this section are not at all subject to titling
or registration under Title 13; therefore, the
present conditional phrase "unless a title or
registration has been issued" should not apply
to them. In subsection (b) of this section, the present
reference to "registration" similarly is
deleted to avoid confusion. Although these
vehicles may be titled under the optional
provisions of §13-103 of this article, they
are not all subject to registration; see
§13-402 of this article. The Commission notes that the General Assembly
did not add here, as it did in §13-102(6) of
this article, a reference to vehicles "moved
only by human ... power". Consequently, for
example, bicycles are subject to the
provisions of this title, even if they are not
registered under the optional provisions of
§13—421 of this title. In light of the policy
suggested by subsection (b) of this section,
the General Assembly might consider whether or
not this section should be amended to except
bicycles "unless a registration has been
issued for them". 14-102. TAKING VEHICLE WITHOUT CONSENT OF OWNER. (A)   UNAUTHORIZED TAKING PROHIBITED. A PERSON MAY NOT DRIVE OR OTHERWISE TAKE ANY
VEHICLE WITHOUT THE CONSENT OF ITS OWNER AND WITH INTENT
TO DEPRIVE THE OWNER TEMPORARILY OF HIS POSSESSION OF
THE VEHICLE, EVEN IF WITHOUT INTENT TO STEAL IT. (B)   CONSENT OF OWNER NOT IMPLIED OR PRESUMED. THE CONSENT OF THE OWNER OF A VEHICLE TO THE
DRIVING OR TAKING OF THE VEHICLE MAY NOT IN ANY CASE BE
PRESUMED OR IMPLIED BECAUSE OF THE OWNER'S CONSENT ON A
PREVIOUS OCCASION TO THE DRIVING OR TAKING OF THE
VEHICLE BY THE SAME OR A DIFFERENT PERSON. REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §4-102. The present references to a violation   of this section as being a "misdemeanor" are     deleted as unnecessary in light of §27-101   of this
article. In subsection (a) of this section, the words
"or otherwise take" are added to conform to
the references elsewhere in this section to
"driving or taking". The present reference to
