Ch. 14

LAWS OF MARYLAND
SUBJECT TO A FINE NOT EXCEEDING $50. (2) ANY PERSON WHO   USES A VEHICLE REGISTERED UNDER THIS SECTION IN ANY WAY   PROHIBITED BY THIS SECTION IS GUILTY OF A MISDEMEANOR AND   ON CONVICTION IS SUBJECT
TO A FINE NOT EXCEEDING $10. (3) ON A SECOND OR SUBSEQUENT CONVICTION OF
ANY PERSON FOR A VIOLATION OF ANY PROVISION OF THIS
SUBSECTION, THE ADMINISTRATION SHALL REVOKE THE
REGISTRATION AND THE RIGHT OF FURTHER REGISTRATION OF
THAI VEHICLE AS A FARM TRUCK FOR A PERIOD OF 1 YEAR. REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 66 1/2,
§3-806 (e) and (f). The present definitions of "farmer" and "farm
products" are deleted as unnecessary in light
of the definitions of these terms in §13—911
of this subtitle; the second to last sentence
of present §3-806 (e) also is deleted as
unnecessary in light of the definition of
"farm vehicle" in §13-911 to the same effect. As to subsection (e) of this section, its
provisions are somewhat of an anomaly.
Paragraph (1) of the subsection establishes a
maximum fine of $50 for any misrepresentation
in obtaining a registration under this
section. The same act already is prohibited
by §13-704 of this title and, under §27-101 (b)
of this article, would be subject to the
standard fine of up to $500. Thus, this
paragraph sets out a penalty that is
considerably lower than that applicable to all
other registrations, including the other
special farm vehicle registration provisions
of this subtitle (cf., §§ 13-924, 13-925,
13-929, and 13-935 of this subtitle, which do
not have a counterpart to this subsection
(e)). Similarly, paragraph (2) of subsection (e)
provides for a maximum penalty of a $10—fine
for violation of the prohibitions of
subsection (d). On the other hand, a
violation of the like prohibitions in the
other special farm vehicle registration
sections of this subtitle would subject a
person to the standard penalty of $500. Finally, paragraph (3) sets forth a penalty
that already is covered by §13-705 (a) (1) of
this title, except that this paragraph
requires the revocation of the registration;
in all other instances, including those
governing other farm vehicles, the
