76 LAWS OF MARYLAND
(J) REFUNDING. "REFUNDING" MEANS THE RETIREMENT AND CANCELLATION
OF BONDS, INCLUDING BONDS OF PRIOR ISSUES, AFTER THEIR
ACQUISITION BY OR FOR THE DEPARTMENT, WHETHER BEFORE, AT,
OR AFTER MATURITY, EITHER IN EXCHANGE FOR OTHER BONDS OR
BY PAYMENT, PURCHASE, OR REDEMPTION WITH THE PROCEEDS OF
THE SALE OF OTHER BONDS. REVISOR'S NOTE: This subsection presently appears as
Art. 94A, §1(k). Present references to "revenue bonds of prior
issues" and to the Maryland Transportation
Authority are deleted as unnecessary for
purposes of this title; in this regard, see,
also, revisor's note to this section, and
§4-101(e) of this article. The only other changes are in style. (K) TRANSIT FACILITY. "TRANSIT FACILITY" INCLUDES ANY ONE OR MORE OR
COMBINATION OF TRACKS, RIGHTS-OF-WAY, BRIDGES, TUNNELS,
SUBWAYS, ROLLING STOCK, STATIONS, TERMINALS, PORTS,
PARKING AREAS, EQUIPMENT, FIXTURES, BUILDINGS,
STRUCTURES, OTHER REAL OR PERSONAL PROPERTY, AND
SERVICES INCIDENTAL TO OR USEFUL OR DESIGNED FOR USE IN
CONNECTION WITH THE RENDERING OF TRANSIT SERVICE BY ANY
MEANS, INCLUDING RAIL, BUS, MOTOR VEHICLE, OR OTHER MODE
OF TRANSPORTATION. REVISOR'S NOTE: This subsection presently appears as
Art. 94A, §1(m). The reference to transit service by "bus" is
added to conform to the like reference in
§7-101 of this article. The only other changes are in style. The wording of the definition of "transit
facility" in this subsection and that of the
definition of "transit facility" in §7-101(f)
of this article read identically; however,
this definition is substantively broader in
its scope than the latter. Both definitions
rely on use of the same term "transit
service"; but, in Title 7 of this article,
this usage necessarily is qualified by the
definition of "transit service" which, in
§7—101(g), includes only service "between
points in the {Metropolitan Transit} District
or in any county contiguous to the District".
This distinction is consistent with the
difference between the Statewide jurisdiction
