In subsection (a) of this section, the present
reference to appeals "pursuant
to...regulations adopted" by the Secretary is
deleted as unnecessary in light of
§2—505(b)(2) of this subtitle and the general
reference to an appeal "provided by this
subtitle".
The last sentence of subsection (c) of this
section is substituted for the sentence
"{r}eceipt of such complaint shall be promptly
acknowledged in writing and a copy transmitted
to the Secretary of Transportation". This is
done to remove any ambiguity as to which
papers are to be sent to the Secretary.
Subsection (g) of this section is revised to
clarify that an acting chairman acts "in {the}
absence" of the chairman, to provide expressly
for the production of documents, and to
clarify the manner in which the chairman may
"compel" the attendance of witnesses. As
revised, the subsection conforms to similar
provisions appearing elsewhere in this
article; see, e.g., §5-209 (c) and (d) of this
article.

review to the courts, see Board of Examiners
