(2) ON RECEIPT OF A CERTIFICATE OF TITLE TO
WHICH IS ATTACHED THE INFORMATION REQUIRED BY THIS
SUBSECTION, THE ADMINISTRATION SHALL PLACE ON THE NEW
CERTIFICATE OF TITLE IT ISSUES A NOTATION APPROPRIATE TO
CONVEY THIS INFORMATION TO THE NEW OWNER OF THE VEHICLE.
(D) PROHIBITIONS.
NO PERSON OTHER THAN A DEALER MAY BUY IN THIS STATE
AND NO PERSON MAY SELL IN THIS STATE ANY USED VEHICLE OF
A TYPE FOR WHICH A CERTIFICATE OF TITLE IS REQUIRED UNDER
THIS SUBTITLE UNLESS:
(1) A CERTIFICATE OF TITLE OF THE VEHICLE HAS
BEEN ISSUED BY THE ADMINISTRATION OR BY ANOTHER STATE OR
COUNTRY; OR
(2) A CERTIFICATE OF REGISTRATION OF THE
VEHICLE HAS BEEN ISSUED BY A STATE OR COUNTRY THAT DOES
NOT ISSUE CERTIFICATES OF TITLE OF SUCH VEHICLES.
REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §3-112.
In subsection (a) (1) of this section, the term
"security interest" is added to conform to the
provisions of §13—107(a)(3) of this subtitle
and to like references elsewhere in this
subtitle.
In subsection (b)(2) of this section, the
words "the applicant" are added and the phrase
"in its discretion" retained - notwithstanding
use of the word "may" — to continue the
present emphasis that the penalty need not be
applied uniformly, but may be assessed on a
case—by—case determination.
In subsection (d) of this section, the words
"or country" are added to conform to the
similar reference in §13—104.2 of this
subtitle. The present express reference to a
violation being "unlawful and a misdemeanor"
is deleted as unnecessary in light of §27-101
of this article. Also, the present reference
to a "second hand" vehicle is deleted as
redundant in light of the reference to a "used
vehicle", which is defined in §11-175 of this
article.
The only other changes are in style.
As to transfers of registration, see Subtitle
5 of this title.
As to subsection (a) (1.) of this section, the
Commission is unsure of the legislative intent
