sections by Ch. 534, Acts of 1970, minor,
apparently unintended, differences in language
were created. The Administration treats these
counterpart criteria identically — as is the
apparent intent — and, therefore, their
language is conformed. Present Art. 66 1/2, §3-110(6) permits the
Administration to refuse a certificate of
title if it determines that the vehicle is
"mechanically unfit and unsafe to be
operated". This criterion, which is
duplicated in §13-406 of this title as to
registration, is deleted here. Although
mechanical fitness and safety is an important
consideration in the registration and
consequent operation of a vehicle, it was not
intended as a proper consideration for
refusing issuance of a certificate of title as
evidence of ownership. (In this regard,
compare Uniform Vehicle Code §3-110 with UVC
§3—406, where this distinction is made between
titling and registration; see, also, §13—705
of this title.) The erroneous listing
originated with Ch. 534, Acts of 1970, in
revising and bifurcating the combined and,
therefore, misleading titling/registration
provisions of prior Art. 66 1/2, §27. It
never has been used by the Administration as a
reason for refusing a certificate of title
and, consequently, is deleted in this
revision. The only other changes are in style. 13-111. LOST, STOLEN, OR DAMAGED CERTIFICATES. (A)   DUPLICATE CERTIFICATE. (1)    IF A CERTIFICATE OF TITLE IS LOST,
STOLEN, MUTILATED, DESTROYED, OR BECOMES ILLEGIBLE, THE
OWNER OR THE LEGAL REPRESENTATIVE OF THE OWNER NAMED IN
THE CERTIFICATE, AS SHOWN BY THE RECORDS OF THE
ADMINISTRATION, PROMPTLY SHALL APPLY FOR AND, AFTER
FURNISHING INFORMATION SATISFACTORY TO THE ADMINISTRATION
AND PAYMENT OF THE REQUIRED FEE, OBTAIN A DUPLICATE
CERTIFICATE OF TITLE. (2)   THE DUPLICATE CERTIFICATE OF TITLE SHALL
CONTAIN THE LEGEND "THIS IS A DUPLICATE CERTIFICATE AND
MAY BE SUBJECT TO THE RIGHTS OF A PERSON UNDER THE
ORIGINAL CERTIFICATE." (B)   SURRENDER OF ORIGINAL CERTIFICATE OF TITLE. IF A PERSON RECOVERS AN ORIGINAL CERTIFICATE OF
TITLE FOR WHICH A DUPLICATE HAS BEEN ISSUED, THE PERSON
PROMPTLY SHALL SURRENDER THE ORIGINAL CERTIFICATE TO THE
