"JUNK" MEANS OLD OR SCRAP COPPER, BRASS, ROPE,
RAGS, BATTERIES, PAPER, TRASH, RUBBER DEBRIS, WASTE,
IRON, STEEL, AND ANY OTHER OLD OR SCRAP MATERIAL,
INCLUDING WRECKED, SCRAPPED, RUINED, OR DISMANTLED MOTOR
VEHICLES OR MOTOR VEHICLE PARTS.
REVISOR'S NOTE: This subsection presently appears as
Art. 89B, §240(a).
The present reference to "ferrous or
nonferrous" material is deleted as
unnecessary.
The present list of adjectives describing
"junked" motor vehicles is revised to conform
with the similar list in subsection (b) of
this section.
The only other changes are in style.
(D) JUNK YARD.
"JUNK YARD" MEANS AN ESTABLISHMENT OR PLACE OF
BUSINESS THAT IS MAINTAINED, OPERATED, OR USED:

|
|
|
(1) FOR STORING, KEEPING, BUYING, OR SELLING
|
|
|
|
|
|
|
|
JUNK;
|
|
|
|
|
|
|
|
|
(2) FOR AN AUTOMOBILE GRAVEYARD;
(3) AS A GARBAGE DUMP OR SANITARY FILL; OR
(4) AS A SCRAP METAL PROCESSING FACILITY.
REVISOR'S NOTE: This subsection presently appears as
Art. 89B, §240(c) and, as to item (4) of this
subsection, Art. 89B, §249(c).
The present phrase "establishment or place or
business" is changed to "establishment or
place of business" to conform with present
§240 (b), now subsection (b) of this section.
It is believed that the use of the word "or"
in the present law is unintentional.
The only other changes are in style.
(E) MAIN TRAVELED WAY.
"MAIN TRAVELED WAY" HAS THE MEANING STATED IN §8-701
OF THIS TITLE.
REVISOR'S NOTE: This section is new language added
to clarify the meaning of the term "main
traveled way" as used in this subtitle, in
conformity with the meaning given the term by
definition in §8-701 of this title.
