Chapter 43
AN ACT to amend Chapter 52, title "Taxation", of the
Montgomery County Code 1972, as amended, by
repealing in its entirety Section 52—16B, title
"Beverage Container Tax" and adding thereto a new
Section 52—16B, title "Beverage Container Tax", to
follow immediately after Section 52—16A thereof, to
levy and impose, beginning July 1, 1976, upon
certain persons who supply in Montgomery County
beverages in non—reusable beverage containers a tax
at the rate of two cents (2¢) upon each non—reusable
beverage container supplied having a normal capacity
up to and including sixteen (16) fluid ounces and
four cents (4¢) upon each non—reusable beverage
container supplied having a normal capacity in
excess of sixteen (16) fluid ounces; to define
certain words and phrases for the purposes of this
tax; to specify the procedure for the collection and
administration of this tax; to provide for a tax
credit in certain circumstances; to set forth
methods of enforcement and penalties for failure to
comply with the provisions of this Act; and to
authorize the adoption of Executive Regulations to
implement this Act.
Effective August 15, 1976.

Chapter 44
AN ACT to amend Chapter 2, title "Administration," of the
Montgomery County Code 1972, as amended, by
repealing and re—enacting, with amendments, Sections
2—112 and 2-113, titled respectively "Powers, duties
and functions," and "Rules of Procedure"; by the
addition of a new Section 2—113A, title "Decisions
on recommendation of examiner"; to follow
immediately after Section 2—113 thereof; and by the
addition of a new Article X, title "Office of
Hearing Examiner"; to delete certain antiquated and
unnecessary language; to provide that the County
Board of Appeals shall have and exercise the
functions and powers of a Board of Zoning Appeals as
prescribed in the Maryland—Washington Regional
District Act, Article 66D of the Annotated Code of
