(II) THE SERVICES OF A ROADS ENGINEER WHO
HAS EITHER A DEGREE IN CIVIL ENGINEERING AND EXPERIENCE
IN CONSTRUCTING ROADS OR AT LEAST 10 YEARS PRACTICAL
EXPERIENCE IN CONSTRUCTING ROADS IN A SUPERVISORY AND
EXECUTIVE CAPACITY.
(3) THE TRANSFER OF FUNCTIONS SHALL BECOME
EFFECTIVE ON THE FIRST DAY OF THE NEXT STATE FISCAL YEAR
FOLLOWING THE REQUEST BY THE COUNTY.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 89B, §§
220 through 222.
Subsection (a) of this section is revised to
include only those counties for which the
Administration currently performs road work on
county roads. The presently referenced
Caroline, Queen Anne's, Somerset, Wicomico,
and Worcester counties have made elections
under the predecessor statute to what is now
subsection (e) of this section and now perform
their own road work.
The last clause of present §222, which
relieves the Administration from further
responsibility as to counties making an
election to do their own work, is deleted as
unnecessary in light of §8—633 of this
subtitle to similar effect and, insofar as it
limited the remaining duties of the
Administration to the counties, inaccurate.
In this regard, see the introductory clause
and re visor's note to §8-633 of this subtitle.
8-635. ENGINEERING ADVICE TO COUNTIES.
AT THE REQUEST OF ANY PROPER COUNTY AGENCY, THE
ADMINISTRATION SHALL PROVIDE TO THE COUNTY ENGINEERING
ADVICE AND INFORMATION ON THE COUNTY'S ROAD PROGRAM,
INCLUDING ITS FARM-TO-MARKET ROAD PROGRAM. THE
ADMINISTRATION MAY NOT CHARGE THE COST OF THIS ADVICE OR
INFORMATION EITHER TO THE COUNTY, TO THE COUNTY'S SHARE
OF HIGHWAY USER REVENUES, OR TO OTHER FUNDS ALLOCATED TO
THE COUNTY.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 89B, §78.
Present Art. 89B, §77, which requires the
Administration to furnish the counties with
maps and programs for improvement of county
roads, is deleted as obsolete and in conflict
with current practice.
