for appropriate public input into and awareness of
governmental decision making process, I issued
Executive Order No. 01.01.1976.02 on May 25, 1976;
and
WHEREAS, That Executive Order requires that executive
public bodies of the Executive Branch of State
Government open their meetings to the public, give
advance notice of meetings, and keep recorded
minutes, except as otherwise provided in the
Executive Order; and
WHEREAS, Pending further possible action by the General
Assembly with respect to the subject matter of the
Executive Order, I requested the Attorney General
and the heads of the principal Executive Agencies to
monitor the effect of the Executive Order, and to
recommend such changes as they deemed appropriate;
and
WHEREAS, Certain amendments have been recommended to me
that I deem appropriate in order to clarify the
intent of the Executive Order, and to make its
policy and requirements more workable; and
WHEREAS, I believe these amendments to be consistent with
the dual objectives of maintaining public
participation in the decision making process and
permitting that process to continue efficiently;
NOW, THEREFORE, I, MARVIN MANDEL, GOVERNOR OF MARYLAND,
PURSUANT TO THE AUTHORITY VESTED IN ME BY ARTICLE
II, SECTION 1 OF THE CONSTITUTION OF MARYLAND, AND
BY ARTICLE 41, SECTIONS 15 AND 15CA OF THE
ANNOTATED CODE OF MARYLAND, HEREBY ISSUE THE
FOLLOWING EXECUTIVE ORDER AMENDING EXECUTIVE ORDER
NO. 01.01.1976.02, EFFECTIVE NOVEMBER 1, 1976:
1. Definitions;
(a) As used in this Executive Order, the following
terms have the meanings indicated.
(b) "Advisory function" means the rendering of
advice or recommendations to an executive
public body or an official of the Executive
Department, and the study or evaluation of
public issues, policies, and matters
preparatory to the rendering of such advice or
recommendations, pursuant to a lawful
delegation of that responsibility by the
executive public body or official.
(c) "Executive function" means the administration
or application of the laws of Maryland or the
