Kent County to charge a fee for the use of certain public
boat landings in the County.
The Attorney General has advised me that House Bill
1149 is in contravention of Article XI-F, Section 9 of
the Maryland Constitution, regarding the taxing powers of
a code county. A copy of the Opinion of the Attorney
General is attached and should be considered a part of
this veto message.
For this reason, I have decided to veto House Bill
1149.

He: House Bill 1149
Dear Governor Mandel:
in our letter of May 18 regarding Senate Bill 814 we
advised that that legislation, in our opinion, would
contravene the provisions of Article XI-E, §9, of the
Maryland Constitution, We perceive no material
differences between the provisions of House Bill 1149 and
Senate Bill 814. Accordingly, we advise, for the reasons
set forth in our earlier letter regarding Senate Bill
814, that House Bill 1149 is constitutionally
impermissible.
