House Bill No. 1065 - Abortions - Procedure and
Safety Measures
AN ACT concerning
Health - Life-Saving Measures
in Late Abortions
FOR the purpose of providing life-saving measures for
certain abortions; generally concerning children
aborted alive; and concerning physicians. where
certain abortions may be performed; providing the
status of a fetus aborted alive; requiring certain
information to be put in certain medical reports;
and providing a penalty.

Dear Mr. Speaker:
In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill
1065.
This bill requires that certain abortions be
performed only in a hospital, mandates that the medical
record of a patient who has had an abortion include
certain information, and provides that a live fetus is to
be treated as an abandoned ward of the State under
certain circumstances.
With respect to each of the three major provisions
of House Bill 1065, the Attorney General has advised me
that there are serious ambiguities and constitutional and
interpretive questions raised by its language. In at
least one instance, the Attorney General has determined
that the bill is clearly unconstitutional. A copy of the
Opinion of the Attorney General is attached and should be
considered a part of this veto message.
