Senate Bill No. 936 - Used Oil - Recycling
AN ACT concerning
Used Oil Recycling Act
FOR the purpose of providing a system for the collection
and disposal of used oil for recycling; defining
certain terms; prohibiting certain actions;
providing for certain rules and regulations; giving
certain authority to the Secretary of Natural
Resources; and generally dealing with used oil
recycling.

Dear Mr. President:
In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed Senate Bill
936.
This bill, entitled the Used Oil Recycling Act,
requires the Secretary of Natural Resources to conduct a
public education program to inform the public of the need
for and benefit of collecting and recycling used oil. As
part of that education program, the Secretary shall
require persons regularly engaged in the business of
selling "lubricating or other oil" in containers for use
off the premises to sell the oil in "resealable or
recoverable" containers, and to maintain signs informing
the public of how and where used oil may be properly
disposed of. The Secretary is further authorized to
designate "appropriate Maryland State Inspection
Facilities" to serve as collection centers for the
deposit of used oil. Presumably, this refers to the
inspection stations licensed by the Automotive Safety
Enforcement Division of the Maryland State Police
pursuant to Title 23 of the Transportation Article.
The bill then provides certain requirements with
respect to these collection centers, prohibits the
disposal of more than 55 gallons of used oil annually
other than by recycling or in accordance with the
Hazardous Substance Act (§ 8—1413.2 of the Natural
Resources Article) , provides for an annual report to the
General Assembly, and sets forth conditions under which
