(A) (1) THE GENERAL ASSEMBLY FINDS THAT UNITS OF
STATE GOVERNMENT ARE UNDER PRESSURE TO DELAY OR ELIMINATE
NEEDED PHYSICAL FACILITY MAINTENANCE AND REPAIR PROGRAMS
BECAUSE OF FISCAL CONSTRAINTS. (2) THE GENERAL ASSEMBLY
FURTHER FINDS THAT LACK OF REGULAR MAINTENANCE AND REPAIR
PROGRAMS RESULTS IN DETERIORATION OF PUBLIC IMPROVEMENTS
AND INCREASED COSTS FOR REPAIR OR FOR THE CONSTRUCTION OF
ENTIRELY NEW REPLACEMENT FACILITIES. (3) THE GENERAL
ASSEMBLY FINDS THAT A SPECIFIC SET OF PROCEDURES IS
NEEDED TO INSURE THAT ALL UNITS OF STATE GOVERNMENT
PERFORM REGULAR MAINTENANCE AND REPAIR PROGRAMS.
(B) PURSUANT TO SECTION 22 (7) OF THIS ARTICLE,
THE DEPARTMENT OF GENERAL SERVICES IS REQUIRED TO
ESTABLISH AND SUPERVISE A COMPREHENSIVE AND CONTINUING
MAINTENANCE AND REPAIR PROGRAM FOR ALL STATE-OPERATED
PUBLIC IMPROVEMENTS. PRIOR TO JANUARY 1, 1978, THE
DEPARTMENT OF GENERAL SERVICES SHALL ESTABLISH GENERAL
POLICIES AND STANDARDS APPLICABLE TO MAINTENANCE AND
REPAIR OF PUBLIC IMPROVEMENTS AND SHALL SUBMIT COPIES TO
THE BOARD OF PUBLIC WORKS AND TO THE DEPARTMENTS OF
BUDGET AND FISCAL PLANNING AND STATE PLANNING. THE
DEPARTMENTS OF BUDGET AND FISCAL PLANNING AND STATE
PLANNING ARE DIRECTED TO ASSIST THE DEPARTMENT OF GENERAL
SERVICES IN THE PREPARATION OF THESE POLICIES AND
STANDARDS. PRIOR TO JANUARY 1, OF EACH YEAR, THE
DEPARTMENT OF GENERAL SERVICES SHALL PREPARE AND FILE ANY
UPDATES OR AMENDMENTS TO THESE POLICIES AND STANDARDS
WITH THE BOARD OF PUBLIC WORKS AND THE DEPARTMENTS OF
BUDGET AND FISCAL PLANNING AND STATE PLANNING.
(C) EVERY UNIT OF STATE GOVERNMENT SHALL CARRY OUT
MAINTENANCE AND REPAIR PROGRAMS FOR THOSE PUBLIC
IMPROVEMENTS SUBJECT TO THE CONTROL OF THAT UNIT OF STATE
GOVERNMENT. THIS MEANS THAT EVERY UNIT OF STATE
GOVERNMENT SHALL CONFORM TO THE POLICIES AND STANDARDS
ESTABLISHED BY THE DEPARTMENT OF GENERAL SERVICES AND
SHALL ALLOCATE SUFFICIENT FUNDS AND PERSONNEL TO
ACCOMPLISH NECESSARY MAINTENANCE AND REPAIR PROGRAMS.
(D) PRIOR TO JUNE 1, 1978, AND PRIOR TO JUNE 1 OF
EVERY YEAR, EACH UNIT OF STATE GOVERNMENT SHALL SUBMIT A
REPORT TO THE DEPARTMENTS OF GENERAL SERVICES, BUDGET AND
FISCAL PLANNING AND STATE PLANNING ON THE CONDITION OF
PUBLIC IMPROVEMENTS UNDER ITS JURISDICTION. THIS REPORT
SHALL IDENTIFY THE PUBLIC IMPROVEMENT AND SHALL STATE
WHETHER THAT PUBLIC IMPROVEMENT IS BEING MAINTAINED IN A-
MANNER WHICH WILL INSURE ITS CONTINUED USE FOR PUBLIC
PURPOSES OF THE STATE ACCORDANCE WITH STANDARDS AND
POLICIES SET FORTH BY THE DEPARTMENT OF GENERAL SERVICES.
THE DEPARTMENT OF GENERAL SERVICES, WITH THE ASSISTANCE
AND ADVICE OF THE DEPARTMENTS OF BUDGET AND FISCAL
PLANNING AND STATE PLANNING, SHALL RECOMMEND MEASURES
NECESSARY TO CORRECT ANY DEFICIENCIES IN THE MAINTENANCE
AND REPAIR PROGRAMS.
