REVISOR'S NOTE: This section is new language derived
in part from Art. 41, §207F(a) and revised and
expanded to conform to similar provisions
appearing in this article as to various
Departmental units that have succeeded to the
powers of former agencies (cf., e.g., §§ 6-213
and 7—212 of this article).
References to the State Roads Commission and
its chairman are added to this section to
recognize the executive reorganization that
made the Commission a unit of the
Administration (see, §8-210 of this subtitle)
and — except as noted in the introductory
clause added to this section — subject to the
general authority of the Administrator (see,
§§ 8—202(b) and 8—203 of this subtitle) and
the Secretary (see, e.g., §2—103(f) and (g)).
Accordingly, throughout this article - except
as noted in the introductory clause to this
section — present references to the State
Roads Commission and its chairman have been
changed to refer, more generally, to the
Administration or the Administrator. Of
course — as recognized by the introductory
clause added to item (2) of this section —
these changes do not preclude the
Administrator or the Secretary from delegating
to the Commission any of the powers and duties
of the Administration that they consider
appropriate; in this regard, see, also,
§8-218(a)(2) of this subtitle.
Although the revision of this article conforms
all references to reflect the executive
reorganization and transfers of authority,
obsolete references may remain in other
articles of the Code as well as in various
rules, regulations, forms, and the like. For
this reason, this section, as revised, is
retained.
