(House Bill 781)
AN ACT concerning
State Board for Community Colleges — Staff
FOR the purpose of requiring the Executive Director and
staff of the State Board for Community Colleges to
join a retirement system; allowing those persons to
select certain alternatives; and allowing certain
professional employees to elect membership in an
alternate retirement system.
BY repealing and reenacting, with amendments,
Article 77A — Higher Education

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 8(c) of Article 77A - Higher
Education, of the Annotated Code of Maryland (1975
Replacement Volume and 1976 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:
Article 77A - Higher Education
8.
(c) From the time of its establishment, the State
Board for Community Colleges may employ a full—time
salaried EXECUTIVE director to carry out its day-to-day
functions under the control of the Board and it may
employ [such] additional staff members[, employees, and
assistants as may be] necessary to carry out the
functions of the Board and as [may be] provided in the
budget [from time to time]. THE EXECUTIVE DIRECTOR AND
ALL OTHER EMPLOYEES OF THE BOARD SHALL BECOME MEMBERS OF
THE TEACHERS' RETIREMENT SYSTEM OR THE STATE EMPLOYEES'
RETIREMENT SYSTEM. HOWEVER, STAFF MEMBERS HOLDING
POSITIONS DETERMINED BY THE STATE BOARD FOR COMMUNITY
COLLEGES TO BE PROFESSIONAL POSITIONS MAY, IN LIEU OF
THIS MEMBERSHIP, BECOME MEMBERS OF THE TEACHERS'
RETIREMENT SYSTEM OR AN OPTIONAL RETIREMENT PROGRAM
PROVIDED IN ARTICLE 77, SECTION 217.
