FOR the purpose of changing certain regulations of the
Baltimore City Board of Liquor License Commissioners
concerning protests at an alcoholic beverage license
application or transfer hearing; defining a certain
terra an certain cases; correcting language; and
generally relating to protest procedure at an
alcoholic beverage license application or transfer
hearing. BY adding to Article 2B - Alcoholic Beverages Section 184(b) Annotated Code of Maryland (1976 Replacement Volume and 1976 Supplement) BY repealing and reenacting, with amendments, Article 23 - Alcoholic Beverages Section 60(d) Annotated Code of Maryland (1976 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 184(b) be and it is hereby
added to Article 2B - Alcoholic Beverages, of the
Annotated Code of Maryland (1976 Replacement Volume and
1976 Supplement) to read as follows: Article 2B - Alcoholic Beverages 184. (B)         THE BALTIMORE CITY BOARD OF LICENSE COMMISSIONERS MAY NOT REQUIRE: (1) THAT PROTESTS AGAINST THE ISSUANCE OR TRANSFER OF ANY LICENSE MUST BE ACCOMPANIED BY AN ABSTRACT OF TITLE FROM THE LAND RECORDS OF BALTIMORE CITY SUBSTANTIATING THE PROTESTANTS OWNERSHIP OF THE REAL OR LEASEHOLD PROPERTY, OR (2) THAT THE ATTORNEY WHO MADE THE ABSTRACT MUST APPEAR AND TESTIFY THAT THE FACTS STATED IN IT ARE TRUE TO THE BEST OF HIS KNOWLEDGE AND BELIEF. THE PROTESTANT NEED ONLY TESTIFY THAT HE IS THE HOLDER OF FULL LEGAL TITLE AS
SHOWN BY THE LAND RECORDS OF BALTIMORE CITY, OR SUBMIT AN
AFFIDAVIT STATING THE SAME IN THE EVENT OF HIS EXCUSABLE
ABSENCE. ANY ONE CO-OWNER OF LEGAL TITLE CAN TESTIFY FOR
AND BIND THE OTHER CO-OWNERS IF ANOTHER CO-OWNER DOES NOT APPEAR AND DENY THAT ALL CO-OWNERS ARE ALL PROTESTANTS AGAINST THE APPLICANT.        THE BALTIMORE CITY BOARD OF LICENSE COMMISSIONERS SHALL NOT REQUIRE: THAT PROTESTS AGAINST THE ISSUANCE OR TRANSFER OF ANY LICENSE MUST BE ACCOMPANIED BY AN ABSTRACT OF TITLE FROM THE LAND RECORDS OF BALTIMORE CITY SUBSTANTIATING THE PROTESTANTS' OWNERSHIP OF THE REAL OR LEASEHOLD PROPERTY, BUT IT MAY REQUIRE THAT A QUALIFIED PERSON FAMILIAR WITH THE LAND RECORDS OF BALTIMORE CITY APPEAR AT THE HEARING AND
