AN ACT concerning
Public Works - Contracts with Persons
Convicted of Bribery
FOR the purpose of disqualifying persons convicted of
certain bribery related offenses from entering into
certain governmental contracts; subjecting a person
to possible disqualification under certain other
bribery related offenses; disqualifying certain
firms and corporations from entering into such
contracts under certain circumstances; providing for
notice; providing procedures for hearings; providing
conditions for reinstating right to contract with
the State; requiring certain reports by the Attorney
General and court clerks; providing for the filing
of an affidavit containing certain information;
prohibiting the State, any county or other
subdivision of the State from awarding contracts to
certain persons, firms and corporations; and
providing that certain records be kept by the Board
of Public Works and be available to the public.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 16D be and it is hereby added
to Article 78A - Public Works, of the Annotated Code of
Maryland (1975 Replacement Volume and 1976 Supplement) to
read as follows:
Article 78A — Public Works
16D.
(A) FOR THE PURPOSES OF THIS SUBTITLE:
(1) A REFERENCE TO THE "STATE" OR A
"SUBDIVISION" SHALL INCLUDE ANY BICOUNTY OR MULTICOUNTY
GOVERNMENTAL AGENCY LOCATED WITHIN THE STATE; AND
(2) THE WORD "CONVICTION" SHALL INCLUDE AN
ACCEPTED PLEA OF NOLO CONTENDERE.
(B) ANY PERSON CONVICTED AFTER JULY 1, 1972, UNDER
THE PROVISIONS OF ARTICLE 27 OF THE ANNOTATED CODE, OF
BRIBERY, ATTEMPTED BRIBERY, OR CONSPIRACY TO BRIBE BASED
