LAWS OF MARYLAND
FARMERS. THEY SHALL OWN AN INTEREST IN 100 ACRES OR MORE
OF LAND FROM WHICH AGRICULTURAL SALES AMOUNT TO $10,000 OR MORE ANNUALLY. THEY SHALL DERIVE MORE THAN 51 PERCENT OF THEIR LIVELIHOOD FROM FARMING. ONE MEMBER SHALL BE A RESIDENT OF EACH ELECTION DISTRICT. THE TERM OF OFFICE MAY NOT EXCEED FOUR YEARS. (B) THE BOARD IS THE CHIEF ADMINISTRATIVE BODY TO IMPLEMENT THE PROGRAM. (C)           THE BOARD SHALL PROMULGATE RULES AND REGULATIONS AND DEVELOP PROCEDURES FOR THE FORMATION OF AGRICULTURAL DISTRICTS AND DESIGNATED AGRICULTURAL AREAS SUBJECT TO THE PROVISIONS OF THIS SUBTITLE. THE RULES AND REGULATIONS SHALL INCLUDE THE FOLLOWING: (1) LOCAL ORDINANCES INCONSISTENT WITH THE NORMAL EFFICIENT FARM OR FORESTRY PRACTICES MAY NOT BE ENACTED OR ENFORCED IN THE AGRICULTURAL DISTRICT. (2) WITHIN AN AGRICULTURAL DISTRICT, EMINENT
DOMAIN IS LIMITED TO THOSE RARE INSTANCES WHERE NO OTHER VIABLE ALTERNATIVE EXISTS.
(3)(2)            SPECIAL ASSESSMENTS MAY NOT BE PERMITTED ON THE BASIS OF FOOTAGE, ACREAGE, ETC., FOR THE
SUPPORT OF ANY PUBLIC SERVICE INCLUDING WATER AND SEWER
SERVICE. MAY APPOINT AN AGRICULTURAL PRESERVATION
ADVISORY BOARD CONSISTING OF FIVE MEMBERS, AT LEAST THREE
OF WHOM SHALL BE OWNER OPERATORS OF COMMERCIAL FARMS WHO
EARN 51 PERCENT OR MORE OF THEIR INCOME FROM FARMING. (B)         ONE MEMBER SHALL BE A RESIDENT OF EACH ELECTION DISTRICT. (C)         ORIGINAL MEMBERS SHALL BE APPOINTED FOR THE
FOLLOWING TERMS: (1)        ONE FOR A TERM OF THREE YEARS: (2) TWO FOR A TERM OF FOUR YEARS; AND (3)        TWO FOR A TERM OF FIVE YEARS. THEREAFTER, TERMS OF OFFICE SHALL BE FIVE YEARS.        A MEMBER MAY NOT SERVE FOR MORE THAN TWO CONSECUTIVE FULL
TERMS. APPOINTMENT TO FILL A VACANCY SHALL BE FOR THE
REMAINDER OF THE UNEXPIRED TERMS. (D)        THE BOARD SHALL ACCEPT AND APPROVE OR REJECT ALL APPLICATIONS, PROMULGATE RULES AND REGULATIONS, AND DEVELOP PROCEDURES FOR THE FORMATION OF AGRICULTURAL PRESERVATION DISTRICTS AND DESIGNATED AGRICULTURAL AREAS SUBJECT TO THE PROVISIONS OF THIS SUBTITLE. THE RULES AND REGULATIONS SHALL INCLUDE THE FOLLOWING: (1)        THE MINIMUM ACREAGE PERMITTED TO JOIN AN AGRICULTURAL PRESERVATION DISTRICT IS TEN ACRES THAT ARE
