(r) "Special Administrative Expense Fund" means
the Special Administrative Expense Fund established by
this article, from which administrative expenses under
this article which are found not to have been [property]
PROPERLY and validly chargeable against federal grants
[shall be] ARE paid.
(S) (1) "INSTITUTION OF HIGHER EDUCATION" MEANS
AN EDUCATIONAL INSTITUTION THAT:
(I) LEGALLY IS AUTHORIZED IN THIS
STATE TO PROVIDE A PROGRAM OF EDUCATION BEYOND HIGH
SCHOOL;
(II) ADMITS AS REGULAR STUDENTS ONLY
INDIVIDUALS WITH A CERTIFICATE OF GRADUATION FROM HIGH
SCHOOL, OR A RECOGNIZED EQUIVALENT CERTIFICATE;
(III) AWARDS AT LEAST A BACHELOR'S
DEGREE, FOR ITS EDUCATIONAL PROGRAM OR PROVIDES A PROGRAM
THAT IS ACCEPTABLE FOR FULL CREDIT TOWARDS SUCH DEGREE, A
PROGRAM OF POSTGRADUATE OR POSTDOCTORAL STUDY, OR A
PROGRAM OF TRAINING PREPARATORY FOR GAINFUL EMPLOYMENT IN
A RECOGNIZED OCCUPATION; AND
(IV) IS A PUBLIC OR OTHER NONPROFIT
INSTITUTION.
(2) "INSTITUTION OF HIGHER EDUCATION"
INCLUDES EACH COLLEGE AND UNIVERSITY IN THIS STATE.
(T) "HOSPITAL" HAS THE MEANING STATED IN ARTICLE
43, §556(B) OF THE CODE.
(U)(1) "EDUCATIONAL INSTITUTION" MEANS AN
EDUCATIONAL INSTITUTION IN WHICH:
(I) PARTICIPANTS, TRAINEES, OR
STUDENTS ARE OFFERED AN ORGANIZED COURSE OF STUDY OR
TRAINING; AND
(II) THE COURSES OF STUDY OR TRAINING
ARE ACADEMIC, TECHNICAL, TRADE, OR PREPARATORY FOR
GAINFUL EMPLOYMENT IN A RECOGNIZED OCCUPATION.
(2) "EDUCATIONAL INSTITUTION" DOES NOT
INCLUDE AN INSTITUTION OF HIGHER EDUCATION, AS DEFINED IN
SUBSECTION (S) OF THIS SECTION.
(V) "GOVERNMENTAL ENTITY" MEANS THIS STATE, ITS
INSTRUMENTALITIES, ITS POLITICAL SUBDIVISIONS,
INSTRUMENTALITIES OF ONE OR MORE SUBDIVISIONS OR ONE OR
MORE STATES.
