MARVIN MANDEL, Governor
streets, highways, alleys, sidewalks, stations,
terminals, and other structures, roads, or parking areas
located on land owned, leased or operated by the state,
Montgomery County, a municipality, Washington suburban
sanitary commission, Maryland-National Capital Park and
Planning Commission, Montgomery County Revenue Authority
or Washington metropolitan area transit authority. (b) Any person violating the prohibitions of this
section shall be deemed guilty of a misdemeanor; and upon
conviction thereof, shall be subject to a fine of not
more than $100.00.] SECTION 2. AND BE IT FURTHER ENACTED, That new
Sections 207 through 217, inclusive, to be under the new
subtitle "Disorderly Intoxication" be and they are hereby
added to Article 2B - Alcoholic Beverages, of the
Annotated Code of Maryland (1976 Replacement Volume and
1976 Supplement) to read as follows: Article 2B - Alcoholic Beverages DISORDERLY INTOXICATION IN GENERAL
207. (A)    A PERSON MAY NOT: (1)    BE INTOXICATED AND ENDANGER THE SAFETY
OF ANOTHER PERSON OR PROPERTY; OR (2)    BE INTOXICATED OR DRINK ANY ALCOHOLIC
BEVERAGE IN A PUBLIC PLACE AND CAUSE A PUBLIC
DISTURBANCE. (B)    A COUNTY, MUNICIPALITY, OR OTHER POLITICAL
SUBDIVISION OF THIS STATE MAY NOT ADOPT ORDINANCES OR
RESOLUTIONS IDENTICAL OR SUPPLEMENTAL TO THIS SECTION,
AND ANY EXISTING ORDINANCE, RESOLUTION, OR OTHER
LEGISLATION INCONSISTENT WITH THIS SECTION IS REPEALED. 208. ANY PERSON WHO VIOLATES THE PROVISIONS OF THIS
SUBHEADING IS GUILTY OF A MISDEMEANOR AND ON CONVICTION
IS SUBJECT TO A FINE NOT EXCEEDING $100 OR IMPRISONMENT
NOT EXCEEDING 90 DAYS, OR BOTH. 209. (A) THE COUNTIES ENUMERATED IN THIS SECTION MAY
ADOPT ORDINANCES OR RESOLUTIONS SUPPLEMENTING THIS
SUBHEADING. THIS INCLUDES THE AUTHORITY TO REGULATE
POSSESSION OR CONSUMPTION OF ANY ALCOHOLIC BEVERAGE ON
ANY PUBLIC PROPERTY, PROPERTY USEE BY THE PUBLIC IN
GENERAL, OR ON ANY HIGHWAY.
