7-705. REFUSAL TO PAY FARE.
(A) PERSON BOARDING VEHICLE MUST PAY FARE.
A PERSON WHO, FOR THE PURPOSE OF ACCEPTING
TRANSPORTATION, BOARDS A VEHICLE OWNED OR CONTROLLED BY
THE ADMINISTRATION SHALL PAY THE CORRECT FARE IN THE
REQUIRED MANNER.
(B) PENALTY.
A PERSON WHO WILLFULLY REFUSES FAILS TO PAY THE
CORRECT FARE IN THE REQUIRED MANNER AND WHO THEN
WILLFULLY REFUSES TO LEAVE THE VEHICLE IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT
EXCEEDING $250.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 64B,
§31A.
For similar provisions relating to
transportation where the charge is not
required to be paid in advance, see Art. 27,
§555 of the Code.
As to subsection (b) of this section, the
Commission is unsure as to whether the General
Assembly, in enacting present §31A, actually
intended the requirement that a person
"willfully refuse" payment for purposes of
culpability. Logically, it would appear more
appropriate simply to require a finding that
the person failed to pay—-for whatever
reason—-and, then, "willfully refused to leave
the vehicle".
7-706. LIBERAL CONSTRUCTION.
THIS TITLE, BEING IS NECESSARY FOR THE WELFARE OF
THIS STATE AND ITS INHABITANTS AND, EXCEPT FOR § 7-705 OF
THIS SUBTITLE, SHALL BE LIBERALLY CONSTRUED TO
ACCOMPLISH ITS PURPOSES.
